Title: The Goverment of Shunde District forces us to break the Family Planning Policy?
Though my english is not good, I will still try to record a story happening on myself. It is not only for showing the difficulties I met with,instead, I wish people can see a more real China from this story happening on an ordinary person, and not only from the TV or other medias. As we know, there is a Family Planning Policy in China, it is a good policy for preventing the rapidly growth of population. And my story is just relevant to this policy, especially the attitude of those goverment staff treated it. The story is as below:
My girl friend lives in Shunde District of Guangdong Province, I will use Qing as her name here. Qing has a daughter with her ex-husband. In 2004, Qing divorced from her ex-husband. At that time, they processed the divorce procedure in the goverment office, and the aggreement was that the fostering rights of their daughter belonged to Qing. But about 1 month later, the ex-husband argued for the fostering rights of their daughter. After some negocaitions, both families made a 2nd agreement themselves, that the fostering rights of their daughter belonged to the ex-husband. Qing, her ex-husband and their parents all agreed and signed on the 2nd agreement.
Some years later, in 2010, I and Qing had the plan to marry and have another baby. Then we found a problem. Theoratically, if Qing has no fostering rights of her only daughter, then I and Qing can have another baby, it complies with the Family Planning Policy. But then we know, the 2nd agreement is made by themselves and it was never submitted to the goverment office. So, on Apr. 6 2010, I sent an email to the goverment hotline of Shunde District, enquiring for the help and solution to this issue.
On Apr. 13 2010, I got an reply from goverment hotline. Accroding to the law, if the new family has no children, they can have the right for a baby. BUT, there is a very special regulation of Guangdong Province, that is, the goverment will only acknowledge the fostering right when divorce, and the change of fostering right will not be acknowledged by goverment. Which means, officially Qing still has the fostering right of her daughter, if we have another baby, it will break the Family Planning Policy.
It seems the reason is that we don't know the law and regulation clearly, but to all friends we talked about this issue, none of them knows about this very special regulation of Guangdong Province. Then in the next couples of weeks, I sent several emails to goverment hotline, emphasizing the fact, e.g. the 2nd agreement is signed about 1 month after divorce, with signatures of both families, the fact that the ex-husband didn't get any advantage from the 1st incorrect agreement, etc. We also think of collecting evidents, e.g. the daughter has lived in the ex-husband's home for many years, and sue to the court to prove the fostering rights actually belongs to the ex-husband. But the goverment hotline just reply with the brief and coldhearted regulation, totally despite the current fact, totally despite the original intention of the Family Planning Policy.
We truely understand the purpose of the Family planning Policy, but under the merciless of goverment staff, this policy has been changed as a cruel tool to tackling the ordinary people, to get more unfair fine for penalty. According to goverment, if people has one extra child, then they must pay social compensation fees to the goverment. In Shunder District, one must pay at least 150,000rmb fine for an extra birth. The annual average income of workers in Shunde District is about 40,000rmb, so the penalty which can also be much more that 150,000rmb is really a big burden to ordinary people.
I have posted this issue in Chinese on BBS since May 2010, including each email I sent to and receive from goverment hotline. it is more than 1 and a half year now. I will go on and wish such unfair thing will disappear one day. "All men are created equal".
