Penalty: Should the Sellers fail to deliver on time as stipulated in the Contract, with exception of “Force Majeure”.The Buyer shall have the right to cancel the Contract and the Seller, in spite of the cancellation , shall still indemnify the Buyer for all losses and expenses incurred to the latter directed attributable to late delivery or failure to make delivery of the goods in accordance with the terms of the Contract without delay .b) Or Seller will postpone the delivery.
Claim: in the case that a deficiency in the quality of the goods is found by the buyers afterarrival of the goods at the port of destination, a claim may be lodged against the sellers within 30 days after arrival of the goods at the port of destination. The claim must be supported by enough reliable evidence …such as certificate or photos approved by a qualified bureau. The seller shall then consider the claim in the light of the actual circumstances.
Other Terms: The contents of the covering L/C shall be in strict conformity with the stipulation of the Sales Contract. In case of any variation requiring amendment of the L/C, the Buyers shall bear the full expense for revision. The Seller shall not be held responsible for potential shipment delays when and if awaiting amendment of the L/C. Further, Seller reserves the right to claim from the Buyers a respective claim for losses resulting there from.
